The Wholesale Electricity Market (WEM) Rule 2.13.45. requires the ERA to produce a six-monthly report which includes:
- investigations completed by the ERA
- breaches or contraventions of the WEM Rules which the ERA concluded have occurred
- warnings issued by the ERA under clause 2.13.36(a)
- proceedings that have been brought before the Electricity Review Board (ERB)
- findings of the ERB on matters referred to them
- orders made by the ERB
- civil penalties imposed by the ERA under clause 2.13.36(c) of the WEM Rules where they have not been set aside by the ERB.
The ERA has adopted a report structure which combines its reporting obligations under the WEM Rules and the Gas Service Information Rules into one report.
From 1 October 2023 the WEM Rules include additional obligations on the ERA to provide summaries of completed investigations, registered breach allegations and warnings issued by the ERA in its compliance report in addition to the proceedings and orders made by the ERB. Even before these obligations became compulsory, the ERA had been including updates on its compliance activities in its compliance reports, including alleged breaches reported to the ERA, outcomes of breach investigations and results of the ERA’s compliance processes.
