To ensure efficient operation of the Wholesale Electricity Market (WEM) in WA, the WEM Rules set up general trading obligations for market participants. These obligations are binding on all market participants.
The ERA is required to develop an Offer Construction Guideline and Trading Conduct Guideline under WEM Rule 2.16D.1. These Guidelines provide regulatory guidance on how market participants can fulfill their general trading obligations under the WEM Rules.
On 8 August 2024, Energy Policy WA (EPWA) published the Exposure Draft of WEM Amending Rules (FCESS Cost Review Amendments) (Exposure Draft). The Exposure Draft proposed amendments to the WEM Rules which affected the ERA’s regulatory guidance to market participants on their general trading obligations.
On 5 September 2024, the ERA published a first draft of the Guidelines and a Draft Report. The ERA sought stakeholder feedback by 3 October 2024. The ERA received seven submissions.
On 29 October 2024, the Minister for Energy approved the WEM Amendment (FCESS Cost Review) Rules (Amending Rules). Schedule 2 of the Amending Rules include changes to the market power mitigation framework and general trading obligations that affect the ERA’s Guidelines.
On 5 November 2024, the ERA published a second draft of the Guidelines and a Second Draft Report.
The ERA is currently seeking feedback on its second draft by 2 December 2024.
The ERA will consider stakeholder feedback in updating its Guidelines.
