On 15 May 2013 Brockman Iron Pty Ltd made a proposal to The Pilbara Infrastructure Pty Ltd for use of two sections of railway. On 14 August 2013 the ERA approved the commencement of negotiations between TPI and Brockman on the proposal.
Floor and Ceiling Costs Determination
TPI provided Brockman with its determination of the floor and ceiling
prices that would apply. The ERA assessed TPI’s proposal and did not
approve the floor and ceiling costs. On 12 September 2013 the ERA
provided its own determination of the floor and ceiling costs to apply.
Following a judicial review initiated by TPI, the Authority was required to re-make the determination. The re-made determination was provided to the parties in December 2014.
Section 10 Decision
The ERA consulted with the public on TPI's request for approval to commence negotiations with Brockman Iron. The ERA issued its decision on 14 August 2013 to approve the commencement of negotiations.
