On 31 December 2014, DBNGP (WA) Transmission Pty Ltd (DBP) submitted proposed revisions to the access arrangement for the Dampier to Bunbury Natural Gas Pipeline (DBNGP). The ERA published an issues paper on 20 April 2015, and received six submissions from interested parties in response.
On 22 December 2015, the ERA published its Draft Decision, which rejected DBP’s proposed revisions to the access arrangement for the DBNGP for the fourth access arrangement period.
DBP submitted its response to the ERA’s Draft Decision on 22 February, 2016, and additional submissions from DBP and public submissions in response to the Draft Decision were received and published by the ERA during March and April 2016.
On 1 June, the ERA published a Notice seeking public comment on a proposed required amendment to capacity expansions that it is considering as part of its Final Decision, and received two public submissions in response.
On 30th June, 2016 the ERA published its Final Decision not to approve all of DBP’s proposed revisions to the Access Arrangement for the DBNGP for the fourth access arrangement period.
On 20 July 2016, the Access Arrangement, Access Arrangement Information and the T1, P1 and B1 Terms and Conditions were republished to correct a number of formatting, referencing and typographical errors in the documents.
DBP challenged the ERA’s Final Decision on proposed revisions to the Access Arrangement for the DBNGP before the Australian Competition Tribunal (ACT). The contested matters were presented at the ACT hearing in February 2017.
On 16 July 2018, the ACT dismissed the DBP’s merits review applications and upheld the ERA’s final decision, made in June 2016. As a result, the ERA’s Final Decision and approved Access Arrangement remain in force.
